<p style="text-align: justify;">Aside from the attempts to stop tax shelters in the United States through provisions of the U.S. Internal Revenue Code, U.S. courts have several ways to prevent tax sheltering activities from happening. The judicial doctrines have a basic theme: to invalidate a transaction that would achieve a result contradictory to the intent or basic structure of the tax code provisions at issue. The following are the judicial doctrines:</p>
<p style="text-align: justify;">1) The Substance over form doctrine</p>
<p style="text-align: justify;">This doctrine is based on the premise that if two transactions have the same economic result, they should have the same tax result. To achieve this a similar tax result, it can be necessary to look at the substance of the transaction rather than the formal steps taken to implement it.</p>
<p style="text-align: justify;">2) The Step transaction doctrine</p>
<p style="text-align: justify;">Similar to the substance doctrine, the step transaction doctrine treats a series of formally separate steps as a single transaction to determine what really was going on with the transaction.</p>
<p style="text-align: justify;">3) The Business Purpose Doctrine</p>
<p style="text-align: justify;">Courts will invalidate a transaction for tax purposes under this doctrine when it appears that the taxpayer was motivated by no business purpose other than to avoid tax or secure some tax benefit. This judicial inquiry largely is dependent on the taxpayer’s intent.</p>
<p style="text-align: justify;">4) The Sham Transaction Doctrine</p>
<p style="text-align: justify;">This doctrine looks for transactions where the economic activities giving rise to the tax benefits do not occur. A clear example of this doctrine is seen in Knetsch v. United States, 364 U.S. 361.</p>
<p style="text-align: justify;">5) The Economic Substance Doctrine</p>
<p style="text-align: justify;">Under this doctrine, courts will invalidate the tax transaction if the transaction lacks economic substance independent of the tax considerations. This doctrines questions whether the purported economic activity would have occurred absent the tax benefits claimed by the taxpayer.</p>

<p>If you treat people sooner or later have to deal with conflicts. The conflict is not inherently bad. Just be at different points of view. As no two people see the world the same way, disagreement becomes normal. In fact, any person who is always with you, this is probably telling you want to hear and not necessarily what they really think. <span id="more-221"></span><br />

The reason is that the conflict is feared that the emotional aspects involved. When there is conflict means that there are disagreements between two or more persons which are usually related to interests or ideas that are personally meaningful for one or all involved.<br />
Unmanaged conflict can lead to bad feelings and even violence. The key to effectively solve it is to learn the skills necessary to become someone good at conflict resolution.<br />
There are three areas where conflicts occur in business<br />
Interpersonal relations<br />
Meetings<br />
Talks<br />
Rules for the diplomatic disagreement</p>
<p>Regardless of the type of conflict dealing with these there are several general rules to follow if you want to bring harmony to a volatile situation.<br />
Reflects your understanding of the position or opinion of the other party. This communicates that you&#8217;re hearing your opinion and taking it into account before I explain yours.<br />
Let the other party know that you value as a person even if his opinion differs from yours. (&#8220;I understand, appreciate, respect, etc..&#8221;) This communicates that you hear and respect their opinion.<br />
Clarify your position or opinion. &#8220;I feel, think, want, etc..&#8221; This communicates that you do not agree but you value your opinion and want to exchange ideas comfortably, not as a contest of superiority.<br />
Becoming a good conflict resolution requires much practice. Just remember that the goal is to reach a compromise with which both to live and with which they can be happy. In other words, find a way in which both sit winners</p>

<p>The problem is that the traditional organization is based on the division of labor functions and departments rather than by activities and processes. That is why changing the mindset required for a <strong><a href="http://www.jeffhenriquez.com/tag/process-approach">management approach</a></strong> focused more on the expected results with the hierarchical structure of command, that is, it requires thinking more as a team and less like bosses and subordinates, and that ultimately, all are responsible for achieving customer satisfaction with the product or service performed.</p>
<p>The <strong><a href="http://www.jeffhenriquez.com/process-approach-to-corporate-governance.htm">process approach</a></strong> is therefore a horizontal <strong>management approach</strong>, where the concern is to achieve effective and efficient results as its primary goal of the organization rather than limiting its activities to the chain of command and that it creates barriers between units functional.</p>
<p>The coordinated work between different departments working together to make a process work effectively is the goal of focusing on processes and functions as a dynamic management system in which responsibility is shared between departments or functional areas.</p>
<p><strong>Types of processes that can be identified</strong><br />
Companies adopting the process approach as part of its management system must define the number and types of processes to meet their business objectives from those currently available and implemented and that it takes to complete the system. This is achieved through a comprehensive assessment will allow us to identify them.</p>
<p><span id="more-180"></span>They fall into three main groups:<br />
* Strategic Processes: Those processes that establish and set goals, policies and guidelines for short, medium and long term<br />
* Operating processes or at: Those who produce the goods and / or services and give value to the productive chain<br />
* Process support: Those who not essential for the production of goods, if they are essential to supporting the rest of the processes working smoothly</p>
<p>Types of processes suggested by the ISO 9000:2008 typical processes of an organization may be:<br />
* Processes for the management of an organization<br />
* Processes for resource management<br />
* Process Undertaken<br />
* Process measurement, analysis and improvement</p>
<p>We recommend using an appropriate combination of classification and typology of processes to create the document which identifies and describes the specific business processes that define them.</p>

			<content:encoded><![CDATA[<p>Before I bought <a href="http://mycleanpcblog.wordpress.com/">My Clean PC</a>, I asked how to speed up my now sluggish computer is a couple of online forums. Most answers I got instructed me to clean the registry in my computer and to do it myself, and not to buy a registry cleaner.<br />
Easier said than done. </p>
<p><img src="http://i3.squidoocdn.com/resize/squidoo_images/-1/lens11816381_1277731318MyCleanPC.jpg" align="left" style="padding-right:5px"> After reading a great deal on how to clean my registry, I gave up and went back to <a href="http://mycleanpcblog.wordpress.com/">Mycleanpc.com</a>. After getting the free download, over 200 errors were found. Against my better judgment, I agreed to pay to have the errors fixed. The whole fix was really fast, much aster than I thought it would be. </p>
<p>Turns out, I am really pleased with my computer now, and I was ready to throw the computer out the window. <a href="http://mycleanpcblog.wordpress.com/">Mycleanpc</a> really did wonders. I can surf much faster now, and my computer boots up twice as fast. The only part I don&#8217;t like is the auto-renewal on certain features unless you cancel but I will probably keep the service. </p>
<p>Besides having the computer cleaned without any effort on my part, I like the fact that I can call anytime 24 hours a day if I need help. Not many companies offer this kind of service. You can even call before you buy, if you have questions. Too many companies are charging now for 24 hour service. </p>
